Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

 

1. Services Offered

SMT Travelz provides Tempo Traveller rental services in and around Bangalore, Karnataka, India, including but not limited to:

• Local city travel rentals (half-day or full-day).

• Outstation travel rentals.

• Airport transfers.

• All rentals include a professional driver and fuel unless otherwise specified in the booking confirmation.

 

2. Booking and Confirmation

2.1 Quotation and Pricing

All prices quoted are based on the itinerary, duration, and vehicle type specified at the time of inquiry. Prices are subject to change until a confirmed booking is made.

2.2 Booking Confirmation

A booking is considered confirmed only upon: a) Receipt of a non-refundable advance payment or deposit as specified at the time of booking. b) Issuance of a formal Booking Confirmation Voucher or email by SMT Travelz.

2.3 Documentation

The customer is required to provide accurate and complete contact details and identification documents as requested for the booking.

 

3. Payment Terms

3.1 Advance Payment

A mandatory advance payment 20% of the total estimated fare is required to confirm the booking.

3.2 Balance Payment

The outstanding balance must be paid while travelling.

3.3 Additional Charges

The customer is responsible for any extra charges incurred during the trip that were not included in the original quote, which may include:

• Extra mileage or hours beyond the agreed limits.

• Toll fees, parking fees, entry taxes (e.g., inter-state permits), and any other statutory charges.

• Driver Batta/Allowances for outstation/night travel as per standard company policy.

 

4. Cancellation and Refund Policy

4.1 Cancellation by Customer

• Cancellation above 48 Hours: 100% refund of advance/deposit.

• Cancellation less than 48 Hours prior to travel: No refund will be provided (100% of the total booking amount will be forfeited).

• No Cancellation or No Refund: Dussehra, Christmas & New Year booking

4.2 Cancellation by SMT Travelz

In the unlikely event that SMT Travelz must cancel a confirmed booking due to unforeseen circumstances (e.g., mechanical failure, force majeure), we will attempt to arrange an alternative vehicle of a similar standard. If an alternative cannot be arranged, a full refund of all amounts paid by the customer will be processed within 7 business days. SMT Travelz shall not be liable for any additional compensation.

 

5. Rental Duration and Usage

5.1 Reporting Time

The rental time starts from the agreed-upon time and location, even if the customer is delayed.

5.2 Usage Restrictions

The vehicle and driver must not be used for any illegal, immoral, or hazardous purposes. The customer must not instruct the driver to exceed legal speed limits or violate any traffic laws.

5.3 Luggage and Passenger Limits

The number of passengers and the amount of luggage must not exceed the specified seating and carrying capacity of the Tempo Traveller booked.

5.4 Vehicle Condition and Damage

The customer is responsible for any damage caused to the interior or exterior of the vehicle by any member of their party during the rental period, including excessive soiling, spillages, or damage to fittings. The cost of repair or special cleaning will be billed to the customer.

 

6. Disclaimer of Warranties and Limitation of Liability

SMT Travelz strives to ensure timely and reliable service. However:

• We shall not be liable for delays or failures to perform resulting from causes beyond our reasonable control, including but not limited to traffic congestion, road closures, accidents, and acts of nature.

• Our liability for any claim arising from the use of our service is strictly limited to the total amount paid by the customer for that specific booking.

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, whether incurred directly or indirectly.

 

7. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration in Bangalore in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The Courts in Bangalore shall have exclusive jurisdiction over any matter related to this agreement.

 

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms & Conditions.
